Divorce Attorney Fee Packages and Trial

Should I be concerned that my Divorce Attorney Fee Package does not include a trial?

That’s a question we can’t answer for you.  It’s a judgment call.  You need to decide what is best for you based on your individual circumstances.  But, we can give you some basic information to help inform your decision.

1.   According to information presented at a Lawyer’s Continuing Education Conference in 2009, it is our understanding that approximately 45,000 family law cases are filed in Minnesota each year.  Approximately 1,000 family law cases go to trial.  Using these figures, this means that roughly 2.2% of all family law cases end in a trial.

    Does this mean that I have only a 2.2% chance of going to trial?

    No, not necessarily.  All family law cases are not created equal.  Some types of cases go to trial much more frequently than others.  We don’t have any hard numbers on that issue.  Anecdotally, it’s been our experience that cases with long-term marriages where spousal maintenance is disputed tend to be the hardest to settle.

2.   You can always decide, at a later date, to have us represent you at trial.  All of our Divorce Fee Packages include the option of paying a flat fee for trial.  If you think a trial will be necessary in your case, ask your lawyer for more information.
